Terms of Service
1. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, and be able to form a binding contract. We ship to United States addresses only.
2. Your account
If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Tell us immediately if you suspect unauthorised use. We may suspend or close an account that we reasonably believe is being used fraudulently or in breach of these terms.
3. Products, descriptions and availability
We work to describe products accurately, but we do not warrant that descriptions, photographs, colours, dimensions or compatibility information are error-free. Screen rendering varies, so colours may differ slightly from the product photograph. Device compatibility lists are provided as guidance; please confirm your exact model before ordering.
All products are subject to availability. We may limit quantities, restrict sales, or discontinue any product at any time.
4. Orders and acceptance
Your order is an offer to buy. A confirmation email acknowledges receipt but does not constitute acceptance. The contract is formed when we dispatch the goods. We may decline or cancel an order — including after confirmation — where the item is out of stock, where a pricing or description error has occurred, where payment cannot be authorised, or where we suspect fraud. If we cancel a paid order, we refund it in full.
5. Pricing and payment
Prices are in US Dollars and exclude sales tax, which is calculated at checkout. Prices may change at any time before an order is placed. Payment terms are set out in our Payment Policy.
6. Shipping and returns
Shipping terms, timescales and geographic limits are set out in our Shipping Policy. Return and refund terms are set out in our Refund & Return Policy. Both policies form part of these Terms.
7. Warranty
Products are covered by any manufacturer warranty that accompanies them. Beyond that warranty and your rights under our Refund & Return Policy and applicable law, products are supplied “as is” and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
Nothing in these Terms excludes or limits any right you have under mandatory consumer protection law.
8. Correct use of products
Charging and power accessories carry inherent risks if misused. You agree to follow all manufacturer instructions and safety warnings, to use products only with compatible devices and at the correct voltage, not to use any product that is visibly damaged or that has been exposed to liquid, and not to leave charging devices unattended for long periods or covered while in use. We are not liable for damage caused by misuse, incompatible pairing, unauthorised modification or third-party devices.
9. Limitation of liability
To the fullest extent permitted by law, thegadgetdrawer and its officers, employees and suppliers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or device use, arising from your use of the site or any product.
Our total aggregate liability for any claim relating to an order will not exceed the amount you paid for that order.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.
10. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of a product, or your violation of any law or third-party right.
11. Intellectual property
All content on this site — text, graphics, logos, images, product photography, page layouts and software — is owned by us or our licensors and is protected by copyright and trademark law. You may not copy, reproduce, republish, scrape or exploit any part of the site commercially without our prior written permission. Third-party brand names and device model names are the trademarks of their respective owners and are used only to indicate compatibility; their use does not imply affiliation or endorsement.
12. User submissions
If you submit a review, photograph, comment or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with the site and our marketing. You confirm the content is yours to submit and is not unlawful, defamatory, misleading or infringing. We may remove any submission at our discretion.
13. Prohibited use
You may not use the site to break any law, to infringe anyone’s rights, to transmit malware, to scrape or harvest data by automated means, to interfere with the site’s security or operation, or to place fraudulent orders.
14. Third-party links
The site may link to third-party sites. We do not control them, do not endorse them, and are not responsible for their content, products or privacy practices.
15. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
16. Changes to these Terms
We may revise these Terms at any time. The version in force when you place an order is the version that governs that order. Continued use of the site after a change constitutes acceptance.
17. Termination
We may suspend or terminate your access to the site at any time, without notice, for breach of these Terms.
18. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in that State, and you consent to their jurisdiction.
19. Severability and waiver
If any provision is found unenforceable, the remaining provisions stay in full force. Our failure to enforce any provision is not a waiver of it.
20. Entire agreement
These Terms, together with our Privacy, Payment, Shipping and Refund & Return policies, constitute the entire agreement between you and us.
